By accessing or using the Gilded Leads platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Gilded Leads LLC, an Arizona limited liability company ("Company," "we," "us," or "our").
Gilded Leads is a software-as-a-service (SaaS) platform designed for licensed life insurance agents. The Service provides tools including but not limited to: lead management and CRM pipeline, automated SMS and email outreach, AI-assisted lead qualification, Google Calendar integration for appointment booking, performance reporting and goal tracking, and lead distribution based on subscription tier.
Gilded Leads does not guarantee a specific number of leads, conversion rates, or income outcomes. Lead availability is subject to supply and demand and may vary by geographic area and market conditions.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are a licensed insurance professional in good standing in the states where you conduct business, you have the legal authority to enter into these Terms, and you will use the Service only for lawful purposes consistent with these Terms.
Access to the Service requires a paid subscription. Subscription tiers, pricing, and features are listed on our pricing page. All subscriptions include a 7-day free trial. You will not be charged until your trial period ends.
Subscriptions automatically renew at the end of each billing cycle (weekly, monthly, or annually, as selected). You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.
We reserve the right to change pricing with at least 30 days advance notice to your registered email address. Continued use of the Service after a price change constitutes acceptance of the new pricing.
All payments are processed through Stripe. We do not store your payment card information. By subscribing, you authorize Stripe to charge your payment method on a recurring basis.
You agree to use the Service only for lawful purposes. You may not:
Violation of this section may result in immediate termination of your account without refund.
You are solely responsible for ensuring that all SMS and phone communications made through the Service comply with the Telephone Consumer Protection Act (TCPA) and all applicable state laws. You represent and warrant that all leads you contact through the Service have provided prior express written consent to receive automated communications.
Gilded Leads provides tools to capture and store TCPA consent records but is not responsible for verifying the validity of consent obtained by third parties. You assume all liability for TCPA compliance related to your use of the Service.
Lead data distributed to you through the Service is provided for your individual use as a licensed insurance agent. You may not sell, transfer, or share lead data with third parties without the express written consent of the lead and Gilded Leads LLC.
Leads distributed through the platform may be exclusive to your account based on your subscription tier. Exclusive leads will not be distributed to other agents in the same geographic area during your active subscription period.
Upon termination of your subscription, you retain access to lead data you have imported or added manually. Lead data distributed through the platform's distribution engine remains the property of Gilded Leads LLC.
The Service, including all software, content, branding, and documentation, is owned by Gilded Leads LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your active subscription.
You retain ownership of all data you import into the Service. By using the Service, you grant Gilded Leads LLC a limited license to process your data solely for the purpose of providing the Service.
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GILDED LEADS LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
GILDED LEADS LLC DOES NOT GUARANTEE ANY SPECIFIC BUSINESS RESULTS, INCOME, OR LEAD CONVERSION RATES. YOUR RESULTS WILL VARY BASED ON YOUR INDIVIDUAL EFFORT, SKILL, MARKET CONDITIONS, AND OTHER FACTORS OUTSIDE OUR CONTROL.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GILDED LEADS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Gilded Leads LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.
You may cancel your subscription at any time through your account settings. We may suspend or terminate your access to the Service immediately and without notice if you violate these Terms, engage in fraudulent activity, or if we determine that your use poses a risk to other users or the platform.
Upon termination, your right to access the Service ceases immediately. Sections 6, 7, 8, 10, 11, and 12 of these Terms survive termination.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Maricopa County, Arizona, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
We reserve the right to modify these Terms at any time. We will provide at least 14 days advance notice of material changes via email to your registered address. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
